Terms of Service

These terms cover your use of Krewe.Tools, the season software for Mardi Gras krewes run by VegasGeek, LLC (“we”, “us”). They apply to krewe.tools, our help sites, and the krewe websites we host. By using any of them, you agree to these terms. If you’re signing up on behalf of a krewe, you’re agreeing for the krewe and confirming you’re allowed to.

Who’s who

  • Krewes are the organizations that use Krewe.Tools to run their season.
  • Members are the people who sign up, pay dues, buy from a krewe’s store or buy event tickets on a krewe’s site.

Each krewe is responsible for its own site: its dues and prices, refund rules, membership decisions, the content it posts and the emails it sends. Questions about any of those go to your krewe. We provide the software that makes them possible.

Accounts

Keep your sign-in details to yourself, and tell your krewe or us if you think someone else has used your account. You’re responsible for what happens under your account. Give accurate information, especially your email address, since that’s how your krewe reaches you.

Payments

Payments on a krewe’s site go through Stripe to that krewe’s own Stripe account. The krewe is the seller, so its name appears on your statement, and it decides on refunds. By paying, you also agree to Stripe’s terms.

Krewes pay us for Krewe.Tools as agreed when they sign up, which may include a platform fee taken from each payment. Krewes are responsible for the taxes that apply to what they sell.

Acceptable use

Please don’t:

  • break the law or anyone else’s rights using Krewe.Tools;
  • send spam, or email people who haven’t agreed to hear from your krewe;
  • upload anything harmful, such as malware, or content that is abusive or that you don’t have the right to share;
  • try to get into accounts, sites or data that aren’t yours, or test or overload our systems without our permission;
  • copy, resell or reverse-engineer the software.

We may suspend accounts or sites that break these rules. Where we reasonably can, we’ll contact the krewe first.

Your content and data

Krewes own their data, including their member records, and members keep the rights to what they submit. You give us permission to store, process and display it only as needed to run Krewe.Tools for you. Our Privacy Policy explains how we handle personal information.

A krewe that stops using Krewe.Tools can ask for an export of its data before it leaves.

Our software

Krewe.Tools, its design and its code belong to VegasGeek, LLC. Using the service doesn’t give you ownership of it. If you send us ideas or feedback, we may use them without owing you anything.

Availability and changes

We work to keep Krewe.Tools running smoothly, especially during parade season, but we can’t promise it will never be interrupted. We may change or improve features over time. If a change takes away something a krewe relies on, we’ll give reasonable notice.

Disclaimers

Krewe.Tools is provided “as is” and “as available”. As far as the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We aren’t responsible for the actions of krewes, members or third-party services such as Stripe.

Limit of liability

As far as the law allows, VegasGeek, LLC won’t be liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim about Krewe.Tools is limited to the greater of what the krewe paid us in the 12 months before the claim, or $100.

Indemnity

If a krewe’s or member’s misuse of Krewe.Tools, or its breach of these terms, leads to a claim against us, that krewe or member agrees to cover our reasonable costs from that claim.

Ending use

You can stop using Krewe.Tools at any time. A krewe can close its site by contacting us. We may suspend or close accounts that break these terms. The sections on payments owed, content, disclaimers, limit of liability, indemnity and governing law still apply afterward.

Governing law

These terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts in Clark County, Nevada.

Changes to these terms

We may update these terms. We’ll change the date at the top, and for significant changes we’ll let krewes know before they take effect. Using Krewe.Tools after a change means you accept the new terms.
